1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the Skytree Property Management website located at skytreepm.com (the "Site"), our resident portal, owner portal, vendor portal, mobile application, and all related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

Skytree Property Management reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated effective date. Your continued use of the Services after any changes constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

2. Description of Services

Skytree Property Management provides residential property management services in the San Diego metropolitan area, including but not limited to:

  • Marketing and listing available long-term rental properties (12+ month leases)
  • Facilitating rental inquiries, showing appointments, and application processing
  • Managing lease agreements, rent collection, and financial reporting for property owners
  • Coordinating property maintenance, repairs, and vendor management
  • Providing online portals for residents, property owners, and vendors
  • Delivering a mobile application for resident account management

The Site serves as an informational and operational platform. Skytree Property Management acts as a property management agent on behalf of property owners and is not the owner of listed properties unless explicitly stated.

3. User Accounts and Registration

Certain features of the Services require account registration. Resident accounts are created on an invite-only basis after a signed lease agreement is in place. By creating an account, you agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain the confidentiality of your account credentials
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate accounts that violate these Terms, contain false information, or are used for unauthorized purposes.

4. Property Listings and Information

While we strive to ensure that all property listings and related information on the Site are accurate and current, we do not warrant the completeness, reliability, or accuracy of any listing information. Listings are subject to change without notice and may include:

  • Rental prices that are estimates and may vary upon application
  • Photographs that may not reflect the current condition of a property
  • Availability information that may be outdated due to real-time leasing activity
  • Amenity and feature descriptions that should be verified during property tours

No listing on the Site constitutes an offer to lease. All leasing arrangements are subject to application approval, credit and background screening, and execution of a formal lease agreement.

5. Rental Applications and Screening

Rental applications submitted through the Site or our partner platforms are subject to screening that may include credit checks, background checks, employment and income verification, rental history verification, and reference checks. By submitting an application, you authorize Skytree Property Management and our designated screening providers to conduct these checks in accordance with applicable law.

Application decisions are made in compliance with all applicable fair housing laws. We do not discriminate based on race, color, religion, sex, national origin, familial status, disability, sexual orientation, gender identity, marital status, source of income, or any other characteristic protected by applicable federal, state, or local law.

6. Payments and Financial Terms

Rent payments and other fees are processed through our third-party payment processor, Stripe. By making a payment through the Services, you agree to Stripe's terms of service in addition to these Terms.

  • Rent Due Date: Rent is due on the first of each month as specified in your lease agreement.
  • Late Fees: Late fees will be assessed in accordance with your lease agreement and applicable California law. Typically, a grace period applies before late fees are charged.
  • Returned Payments: Returned or failed payments may incur additional fees and may trigger delinquency procedures.
  • Payment Records: Payment history is available through the resident portal and is maintained in accordance with our data retention policy.

Skytree Property Management does not store credit card or banking information. All payment credentials are handled exclusively by our PCI-compliant payment processor.

7. Maintenance Requests

Residents may submit maintenance requests through the resident portal or mobile application. By submitting a request, you agree to:

  • Provide accurate descriptions of the issue, including photographs when possible
  • Grant reasonable access to the property for inspection and repair
  • Classify request urgency accurately (Routine, Urgent, or Emergency)
  • Understand that emergency maintenance (flooding, gas leaks, fire, security issues) should be reported by phone immediately

Response times vary by urgency level. Emergency requests are addressed as quickly as possible, typically within hours. Routine requests are generally addressed within 2-5 business days, subject to vendor availability and parts procurement.

8. Intellectual Property

All content on the Site — including but not limited to text, graphics, logos, images, software, photographs, neighborhood descriptions, and property descriptions — is the property of Skytree Property Management or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may not:

  • Copy, modify, distribute, or reproduce Site content without prior written consent
  • Use our trademarks, logos, or branding without authorization
  • Scrape, crawl, or use automated tools to extract data from the Site beyond what is permitted by our robots.txt
  • Frame the Site or use meta tags or hidden text utilizing our trademarks

9. Prohibited Conduct

When using the Services, you agree not to:

  • Provide false, misleading, or fraudulent information in any form submission or application
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Services for any unlawful purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
  • Interfere with or disrupt the Site or servers connected to the Site
  • Transmit viruses, malware, or other harmful code
  • Use the Site to send unsolicited communications or spam
  • Violate fair housing laws through discriminatory inquiries or conduct

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Skytree Property Management DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE, INCLUDING PROPERTY LISTINGS, PRICING, AVAILABILITY, OR NEIGHBORHOOD DESCRIPTIONS. ALL SUCH INFORMATION SHOULD BE INDEPENDENTLY VERIFIED BEFORE MAKING ANY LEASING DECISIONS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, Skytree Property Management, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO Skytree Property Management IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Skytree Property Management, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any content you submit through the Services.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Services shall first be addressed through good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue resolution through mediation administered by a mutually agreed-upon mediator in San Diego County, California.

If mediation is unsuccessful, either party may pursue binding arbitration or litigation in the state or federal courts located in San Diego County, California. Nothing in this section prevents either party from seeking injunctive or other equitable relief in court where appropriate.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You consent to the exclusive jurisdiction of the state and federal courts located in San Diego County, California for any legal proceedings arising out of these Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any lease agreements or service contracts you have executed with Skytree Property Management, constitute the entire agreement between you and Skytree Property Management regarding the use of the Services. These Terms supersede any prior agreements or understandings, whether written or oral, regarding the subject matter herein.
